Vigils in support of access to education spring up around the state–Greenville’s Vigil

I recently attend a Vigil that was organize by the Adelante Education Coalition. I attend the one  in Greenville, North Carolina. Here is the Photos taken at this event.

The turnout was small but still full of high hopes and spirit.

I borrowed a digital records, which has some issues, I didn’t record the opening statement by Juvencio Rocha Peralta, which I’m truly sorry for. However he spoke with great passion and spoke of fairness for those whom where bought here against their will at a very young age. How they don’t have a true feeling of home. Torn between counties.One they don’t know and the one they love, and live in.

Juvencio Rocha Pertalta had this to say,

“They are trying to stop kids from continuing their education,” Peralta said. “It's not fair to allow them to go to school K-12 and then not allow them to continue their education.”

“This country benefits from undocumented workers,” he said. “Why shouldn't they get the benefits of higher education?”

North Carolina need a more educational workforce, not less educational one, in these tough economic times we want our leaders in Raleigh to do the right thing. I would like to bring a bit of comparison specially. We, up here on this side of the river; as they say in here Greenville. Some people refer to highway 11that goes by the airport as Bethel highway. Many you may not have been aware, I certainly wasn’t in this part of eastern NC, I been here 26 years. Prior to my arrival apparently the huge multi-national corporation known then as Burroughs-Wellcome was planning to located in the little town of Bethel, those whom own the land, who used to own slaves, chose not to welcome the huge pharmaceutical multi-national and Greenville got Burroughs-Wellcome that became Glaxo-Wellcome known now as DSM. Provide a lot of jobs. People of Bethel could have those jobs. Instead the land owner the backward people of northern part of Pitt county choose to try to keep blacks in their kitchens and in their fields they didn’t want them to get those better paying jobs at a huge pharmaceutical company, that meant Bethel stay a very small poor town, all but for the land owners that used to own slaves

Why do I tell that story it the same ignorance small minded, same kind of exclusion way of thinking that characterize this bill in Raleigh. HB11which was introduced on January 27, 2011. That is a minimal progress, minimal human rights and if anything that the coalition against racism here in Pitt County support the rights of everyone to have equal access to education all levels not just elementary and secondary but in college, it’s only fair.

The North Carolina Bill HB 11 is a nothing more than a way to keep those whom have less in state of ignorance and illiterate. keeping them at a sub-level below everyone else. Basically just like the Whites in the south try with African-Americans.

Gay Marriage Ban coming to NC, What will the community do now?

RALEIGH - The economy dominated the fall campaign, but leaders among North Carolina's social conservatives believe the Republican sweep at the Legislature should finally permit a vote on a state constitutional amendment to ban gay marriage.

Will this happen this coming up year? that is the Question, however my question is what the fuck will the LGBT Community do about it.

Back in 2009 NC4Marriage had a rally to consider this topic, only about 14 members of the LGBT community protested this rally.While our so-called damn leaders didn't do a thing, and didn't want us to hold a counter-protest. Instead they wanted us to attend the NC Equality Day of Action.

However these very same individuals come out if Force When NOM was coming to town. Yes, everyone who didn't do a thing about NC4Marriage gather in Raleigh to let Brain and Maggie know that we would fight them on this issue.

One might ask just who are the LGBT Leaders in NC. To date we have Two Bloggers who fit this, a Equality group and a state LGBT newspaper. These individuals have the power to get the community to rally. Yet, only does so on the events they want. Not those that are needed.

Our local leaders are failing big time.

So I will name names here now and ask what they are going to do about it.

So NC Equality, Pam, and those at Q-notes, will you get the community to come out in force over this, or will you just site in front of your damn computer and do not a fucking thing once again. Like you guys did when NC4Marriage bused people into Raleigh. Will Q-note finally do some true and honest reporting on this matter, Will Pam Houseblend finally support those actions, (the major and the minor) in her own backyard? Or will you just follow the national groups and listen to them over those whom live in North Carolina

Sheriffs want lists of patients using painkillers

This is one of our elected sheriff who wants to know what types and how much legal drug you are taking

Sheriffs made their pitch Tuesday to a legislative health care committee looking for ways to confront prescription drug abuse. Local sheriffs said that more people in their counties die of accidental overdoses than from homicides.
For years, sheriffs have been trying to convince legislators that the state's prescription records should be open to them.
"We can better go after those who are abusing the system," said Lee County Sheriff Tracy L. Carter.
Others say opening up patients' medicine cabinets to law enforcement is a terrible idea.

Look, first statement they are concern over accidental overdoses, then they talk about finding those you are abusing the system..

We don't need these type of sheriffs at all, you wants to play with the big boys whom make laws... if they do then let them run for those offices..

Hate CrimeBill and the Obama HRC dinner Speech

Last night the House of Representatives voted down a GOP motion to strip the hate crimes act from the defense authorization bill to which it's attached. The vote was 234-178, virtually exactly along party lines. Tomorrow the House will see a final conference vote on the bill, after which the Senate will see a conference vote before the bill lands on Obama's desk. That may not happen until next week, but there appears to be a chance that President Obama may have something very nice in his pocket when he appears at the HRC dinner on Saturday. Below, Barney Frank defends attaching the hate crimes act to the DOD authorization.

I would not be surprise that this bill will be pass by the end of the week, and for Obama to Use it in speech at the HRC dinner, where he will either sign the bill or tell those rich ass HRC dinner guest, that he will sign the bill first thing Monday morning. To show that he is keeping his word..

Do We Really need Hate Crimes laws

Do we really need this law? Does this law make us more of a victim?

Hate crimes (also known as bias motivated crimes) occur when a perpetrator targets a victim because of his or her membership in a certain social group, usually defined by racial group, religion, sexual orientation, disability, ethnicity, nationality, age, gender, gender identity, or political affiliation.

Hate crime can take many forms. Incidents may involve physical assault, damage to property, bullying, harassment, verbal abuse or insults, or offensive graffiti or letters.

I firmly believe that all crimes are base in hate, so why do we really need this law, I believe that we don’t. This type of law makes us more of a victim then we really are. By asking for and pushing for a passage of a law of this type we are telling others that we are weak that we need to be protect more than others.

These laws only add in many case five years to a sentence, it tells why a person was attack; however the real crime gets push in the background. All we hear it that a person was a victim of a hate crime, ok but what was the real crime, was the person attack with a knife, were they shot, hit with a blunt object. These are the crimes that really matters, not the motivation behind the attack.

Each of these crimes is covered under current laws already, it is these laws that need to be enforce and apply equally. These laws are the laws that we need to make sure that the local DA apply and enforce equally no matter who the victim is.

Asking for more so-call special laws to protect a class is just wrong.

To try to isolate motivation in cases such as rape and murder to fit into one of two categories is ridiculous. The victims in either case suffer the same result. To legislate different penalties based upon a changing definition of what constitutes hate criminalizes thought and not actions.

In a free society, one's thoughts and ideas should be protected even if they offend the sensitivities of other groups. It’s when a physical crime is perpetrated, regardless of the motivation, that the same punishment should be enforced.

Photography is Not a Crime

The economy is in shambles. The war is costing billions. And the country is adjusting to a new president (thank God).
But what does a New York Congressman want to do?
Outlaw cell phone cameras that don’t make a clicking sound when you press the shutter.
The “Camera Phone Predator Alert Act” was introduced earlier this month by Pete King, a republican who believes too many children have been “exploited by photographs taken in dressing rooms and public places with the use of a camera phone”.
The bill makes no mention as to why children would be in a dressing with an adult stranger in the first place, but it would mean the children would hear a clicking sound when photographed by this stranger.

Q-notes story Second Stonewall

I love the article that Matt has written over at Q-notes

There are a few points that I don't agree with.

If only we’d seen such a movement before the election. Or perhaps before the other 27 states in the union defined me as a second-class citizen. I guess now was the appointed time for the bubble to burst.

I don't feel like an a second class citizen. For one I don't make life around the fact that I'm gay. I have told some of my str8 friends that I not what many think what a gay guy is. Yes at times I'm a bit fem, however what I mean, most of the typical stereotype of a gay man and his life style I don't fit at all.

Yes I can cook, but then again I do live with a chef, I do keep my home clean, however it surely not spotless and everything at times are not in their place. I don't travel far away lands for a holiday, I do own my own home. I don't lunch with the boys or girls on a daily bases. I don't hang out at the bars. I do what I want when I want.

We have all the rights as str8, with the exception of Marriage, this is the only thing that separates us. Gays and Str8 have to take the same driving test, we have just about the same types of bills to pay each month, we eat and drink to stay alive. When we get sick we go doctors as well. We spend our money on just about the same items. We can even have kids too.

Yes many will claim till we have marriage we will never be fully equals. Well I hate to bust your bubble but we will never be equal, simply because life isn't equal nor fair. Hell, men and woman are not equals, in many cases, there are thing women can do better then men, and vice versus. Women can have give birth, men can't, even our bodies are different.

When my rights are put up to simple majority vote — everything has changed. 

Ok one thing that we forget is that every right we have today was voted on in some matter. Yes sadly this is true, every right we have was voted on, even the bill of rights were voted on and agree upon before they wrote it. The right to vote was even voted on. Most of our basic rights we never had the chance to vote on, they were voted on for us by people who must of us don't even know. Congress votes on our rights every year, what new rights will they give us and which ones will they take away. To think about even these judges in higher courts are basically voting went they decided to allow gay marriage in CA. One thing we must not forget is they We have to right to vote and the right to bring such proposition for a vote during election time.

If you think these rights that are written in our Constitution are forever, then you are wrong, felons have lost their rights to vote, to own guns, I don't see anyone fight for their rights to vote again. I agree that they shouldn't be allow to own guns. If you are convicted of a felony no matter what class of felony, if you are a Doctor, Lawyer, Accountant, Police Officer, and many other fields once convicted you also lose your job as well, since you can own a gun mean you can't be a cop, felons can't be bonded, so their goes your accountant job, if you are lawyer you are disbarred, and if you are a doctor you can no longer write scripts for meds. Did we the public get to vote on these rights, no they were voted on for us by our elected officials.

The only true second class citizens are those who have been convicted of a felony.. They are the one who have many of their rights taken away form them.

Marriage
There are over 1000 legal protections that automatically come with marriage, which gays are not allowed to have (except for one state) and none are recognized federally. Even civil unions carry no weight on a federal level.


Workplace Discrimination
There are many places in this country where a homosexual can be fired simply for being gay, since homosexuality isn’t covered under the Employment Non-Discrimination Act. Currently, 33 states allow firing based on sexual orientation and 42 states allow firing bases on gender identity. The federal government doesn’t seem to care.


There is currently a bill in my state legislature that would prohibit public colleges from providing same-sex partner benefits to their employees, a reaction to one college deciding to offer them.


Foster Care & Adoption
Many states do not allow homosexuals to adopt or foster children.


Immigration
Many gay couples are torn apart because they fall in love with someone that lives in another country. Since they can’t marry, the foreign partner can’t automatically become a citizen, which would be the case with a straight marriage.


Health Insurance Benefits
Since we can’t marry, our partners aren’t covered by our insurance plans at work. A few companies and states are beginning to offer benefits to same-sex couples, while the federal government turns a blind eye to the injustice.


Military
Gay aren’t allowed to serve openly in the military, although studies have shown that countries that allow gays to serve don’t have problems with morale (the main reason given by our government).


The list goes on and on…

Military, true we can't serve while be openly out, but then agian we have serve in silent from years..
Health Insurance Benefits: sorry these are not really rights, but most insurance benefits depends on your company not the insurance company...
Immigration: this is a right either, there are many who are not allow to Immigrant there. so this a right at all.
Foster Care & Adoption: where is it written this is a right, many str8 single and couple can't adopt either so this really isn't a right at all.
Workplace Discrimination: please we all know you can be fire for any reason, just because we hae define a few reason why we can't be fired doesn't mean that a person isn't fire for them..
Marriage: well what can I say on this one.

So just remember the rights you have to day, may not be the rights you have tomorrow.

After this I think we should do away with turkeys for Thanksgiving

SNT: Connecticut Supreme Court on Gay Marriage...

The Connecticut Supreme Court decided today that same-sex couples in the state are legally entitled to marriage.

Eight same-sex couples sued in 2004, saying their constitutional rights to equal protection and due process were violated when they were denied marriage licenses. The plaintiffs wanted the court to rule that the law discriminates against them because it applies only to heterosexual couples, therefore denying gay couples the financial, social and emotional benefits of marriage. Great another court making new law, this issue need to be decided by the people, not the courts,  We need to stop forcing this issue, yes the state's Supreme Courts make any ruling they like, then the lawmakers can followed shortly thereafter by a public referendum permanently banning gay marriage in the state constitution.

Enough is Enough, marriage isn't for everyone, in short I would love to see us do away with Marriage all together.
UPDATE: Connecticut's Republican Governor, Jodi Rell, won't fight the ruling:

“I disagree with today’s State Supreme Court ruling but as governor, I will uphold it. I continue to believe that marriage is the union of a man and a woman.

I also believe that the historic civil union law that I proudly signed in 2005 is equitable and just. We were the first state to enact such a law through legislative action and not a court mandate.

The Supreme Court has spoken. I do not believe their voice reflects the majority of the people of Connecticut. However, I am also firmly convinced that attempts to reverse this decision – either legislatively or by amending the state Constitution – will not meet with success. I will therefore abide by the ruling.”

SNT: "shocking" Governor Schwarzenegger Vetoes Harvey Milk Day,

This week, California Governor Arnold Schwarzenegger vetoed a bill which would have made Milk's birthday a state-wide "day of significance."

Milk was the United States first openly gay man to hold a public office and was murdered, along with San Francisco mayor George Mascone, in 1978. Conservative groups pressured the governor to employ his veto power.

Schwarzenegger said he respected the intent of the bill, but "contributions should continue to be recognized at the local level."

This shock you how? Please everyone knew that sorry SOB wasn't going to sign it in to law. I remember the rumors about Arnold being gay and having a sugar daddy in the USA when he first came to the States. I'm just so glad that he isn't a natural born citizen, and because of this he can never be President of the USA. Then again there is this: Schwarzenegger is shown smoking a marijuana joint after winning Mr. Olympia in the 1975 documentary film Pumping Iron. In October 2007, Schwarzenegger defended his actions with the claim that, "[Cannabis] is not a drug. It's a leaf." Yet if there was a bill to legalize Cannabis, i bet he would veto it too.

A legal fight erupted Tuesday over the ability of consumers to copy DVDs onto their computers, setting the stage for a new battle between Hollywood and a purveyor of technology that could alter how consumers watch movies at home.

The six major Hollywood movie studios sued Seattle-based Real Networks, asking a federal court in Los Angeles to bar the digital media company from distributing new software that they say lets consumers copy movies illegally.

If this is a major problem for Hollywood, then why are they including a digital copy of the movies on DVDs now. I have five movies that have digital copies that I can download on my laptop and if I wanted I could share them over the net.

Did Hollywood raise the same complaints when VHS video recorder came out..

Now Nice! No Charges for the Rep from FL. Mark Foley

Bet you almost forgot about him. An investigation has been ongoing since Foley stepped down over his inappropriate online communications with underage pages, and two federal law enforcement officials told the AP they were expecting no charges:

I guess we should have got Chris Hanson from Catch a Predator and Perverted-Justice to investigate Him. I guess the states GOP members and the DC's GOP once again protected one of their own. If what he did wasn't criminal then all other would were convicted doing the same thing should be free, right. Now child predator need to be in jail, and Mark should be there too. However I bet even if he was charge I bet he would have gotten a nice plea deal, with no jail and he doesn't have to register as a Sex offender.

Thirteen years after he was acquitted of killing his estranged wife and her friend, O.J. Simpson is back in the courtroom, one more tarnished star drawing attention in a city well accustomed to tired acts.

 

Simpson, 61, is accused of robbing a pair of sports memorabilia dealers at gunpoint at a Las Vegas hotel and casino a year ago. 

I feel that this time OJ is going to Jail for a while. Which I know will make the Goldmans very happy.

So our need for a special laws sometimes conflict with our other rights. Most hate crimes can only be apply to the state level, the federal limits that type of hate crimes.

When the DA of any state includes this charge it’s always with laws that already exist on the books. Those are the laws that we need to address and fight for. So when you get bashed there are laws already on the books to handle this type of crime, so why do we need a special law to go along with it. In most state the hate crime law only adds five years to the sentence.

Over the years we should have fought to have these laws apply to protect us instead of asking for special laws.

The hate crime laws isn’t use evenly anyway. Since it not use every time when a White and Black person gets into a fight, or when a Christian and Muslin get in one either. It’s never applies when two of the same gets into, is it. Just as if a gay person beats the shit out of a drug queen or another gay person. It can only be an assault charge, and the hate crime statue doesn’t apply. However it’s applied by law when a Str8 attacks a gay person.

Then there is hate speech:

Hate speech is a term for speech intended to degrade, intimidate, or incite violence or prejudicial action against a person or group of people based on their race, gender, age, ethnicity, nationality, religion, sexual orientation, gender identity, disability, language ability, moral or political views, socioeconomic class, occupation or appearance (such as height, weight, and hair color), mental capacity and any other distinction-liability. The term covers written as well as oral communication and some forms of behaviors in a public setting. It is also sometimes called antilocution and is the first point on Allport's scale which measures prejudice in a society.

However,

In the United States, government is broadly forbidden by the First Amendment of the Constitution from restricting speech. Jurists generally understand this to mean that the government cannot regulate the content of speech, but that it can address the harmful effects of speech through laws such as those against defamation or incitement to riot.

The fact that such laws apply only to the victimization of specific individuals has led to disputes regarding how such laws should be regulated, if they are to be regulated at all. Among those who hold that hate speech must be regulated, it is undecided as to whether hate speech should be regulated by the state or by voluntaristic communities. Criticisms of hate speech regulation include the view that such legislation would be unjust to those with controversial political or social views.

SNT: Raleigh man pleads guilty to HIV health law violation

RALEIGH — A gay, 23-year-old man received a suspended 45-day jail sentence, 30 months of probation and a $300 fine, plus court costs, after pleading guilty Aug. 22 to charges stemming from violations of North Carolina’s public health laws relating to the spread of HIV.

Joshua Waldon Weaver, a DJ at clubs in Raleigh and Wilmington, was accused of failing to use a condom and failure to notify sexual partners of his HIV-positive status. According to filing documents, the offenses occurred from Aug. 1, 2006 to the time of the charges.
