Sheriff Steve Bizzell told the station that as they continue to investigate the case, the status could change if evidence supports it being a hate crime. Other agents have joined the investigation including, the State Bureau of Investigation and federal Bureau of Alcohol, Tobacco, Firearms and Explosives.
A search warrant obtain by WRAL on Monday indicates that the blaze was set from within the home but does not states exactly how it started. The couple refused media requests for an interview, but neighbors said the men have been harassed on several occasions over the past year.
Bizzell would not comment on the arson investigation but did say his office was aware of two previous reports of harassment. An incident in December, involved a note in the mailbox saying "move sinners" and a second incident was in November involving a homophobic slur left on the back of the house. Deputies said one was home when the fire broke out between 1:30 a.m. to 3:15 a.m. Friday. One of the neighbors called 911.

The North Carolina fire is at least the second arson fire targeting gay men in recent weeks. You'll recall that in late January, a disabled gay man in Carroll County, Georgia was threatened with anti-gay slurs and then his home was set ablaze. No suspects have been arrested. The Federal Bureau of Investigation is assisting in the investigation. Georgia is only one of five states without a hate crimes law.

The American Civil Liberties Union of North Carolina Legal Foundation and other civil rights groups in the state on Tuesday filed a public records request with the Johnston County Sheriff’s Office in the wake of what they deemed to be racially inflammatory statements from Sheriff Steve Bizzell.
Bizzell called Mexicans “trashy” and said the growing Latino population in his county was “breeding like rabbits.” Bizzell has indeed apologized, because even he understands what his “blanket assertions” were, wrong and hateful, period. If he had talked about the strains of “illegal immigration” on our county, his staff, and the costs to the taxpayers he would have been fine. But he crossed the line, made comments that were at least inappropriate, and at worst an embarrassment for someone in his position that smacks of unnecessary comments about race. Maybe Steve needs a plate of spaghetti or a taco to loosen up a bit. – [markcrouch]
